Wilcox Attorneys: Jurors Did Not Believe Witnesses
A judge declared a mistrial in the case of the man accused in the fiery crash on Avon Mountain three years ago that killed four people.The judge declared the mistrial at about 3:30 p.m. Wednesday after jurors said they were still deadlocked, 3-3, as they were Tuesday.
Mistrial In Wilcox Trial
David Wilcox owned the truck that barreled down Avon Mountain on July 29, 2005, and jurors were asked to determine if he knew that the liability insurance on his truck was suspended or if he tried to reinstate it right after the crash.Wilcox left court without comment."We're prepared to do it all over again," defense attorney Raymond Hassett said.Defense attorneys said the jurors did not believe the state’s key witnesses who linked Wilcox to insurance fraud.Those witnesses included the company bookkeeper who testified that Wilcox's wife, Donna, said David Wilcox asked her to get liability coverage restored just after the crash.That information did not appear in her statements to police."While we would have been more pleased with a finding of not guilty, this indicates that in fact the state was unable to prove its case," Hassett said.Donna Wilcox pleaded no contest in February for her role in the insurance fraud case.The case is just the first against Wilcox. He also faces manslaughter charges in a separate case that was expected to go to trial later this year. That will likely be delayed for the retrial
